GENERAL TERMS AND CONDITIONS OF CONTRACTING
IDENTIFICATION OF THE OWNER
In compliance with the provisions of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), it is hereby stated that this website is owned by:

PURPOSE
These General Terms and Conditions govern the contracting of tourist accommodation services offered through the website, consisting of the reservation of tourist apartments for the dates, prices, and conditions selected by the user during the booking process.
BOOKING AND CONTRACTING PROCESS
The booking will be made through the form provided on the website.
Once the booking process has been completed and the corresponding payment has been made, the user will receive a confirmation by email.
The booking shall be considered formalized and binding at the moment the user completes the contracting process and expressly accepts these General Terms and Conditions.
PRICE AND PAYMENT METHOD
The prices indicated on the website include all legally applicable taxes, unless expressly stated otherwise.
Payment shall be made using the methods enabled on the platform. If payment cannot be processed, the booking may be automatically canceled.
CANCELLATION POLICY BY THE CUSTOMER
The customer may cancel the booking under the following terms:
With more than 30 days’ notice prior to the check-in date: a penalty of 10% of the total booking amount.
Between 29 and 7 days prior to the check-in date: a penalty of 50%.
With less than 7 days’ notice or in the event of no-show: a penalty of 100% of the booking amount.
If the customer voluntarily leaves the accommodation before the end of the contracted stay, no refund of the amounts paid shall be issued, unless the cause is attributable to the company.
MODIFICATIONS OR CANCELLATIONS BY THE COMPANY
In the event that, due to unforeseen circumstances, force majeure, or causes not attributable to the company, the reserved accommodation cannot be occupied, the company shall offer the customer:
an alternative accommodation of equal or higher category, or
a full refund of the amounts paid, if the customer does not accept the proposed alternative.
CHECK-IN, CHECK-OUT, AND ACCOMMODATION RULES
Check-in and check-out times shall be those indicated in the booking information.
In accordance with current regulations regarding traveler registration, all guests must identify themselves with an official identity document. For this purpose, the owner may request an image of the identity document and, where applicable, a selfie, through the systems enabled for online check-in.
The customer undertakes to comply with the rules of use of the accommodation and to make proper use of the facilities.
LIABILITY
The company shall not be liable for damages arising from improper use of the accommodation by the customer, nor for incidents attributable to external causes or force majeure.
In no case shall the rights recognized by current consumer and user protection regulations be limited.
PERSONAL DATA PROTECTION
In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), the personal data provided during the booking process shall be processed by YBA Gestión SL, as data controller, for the following purposes: management of the booking and provision of the accommodation service; compliance with legal obligations, including those related to traveler registration; handling inquiries, requests, or complaints.
The legal basis for the processing is the performance of the contract and compliance with legal obligations.
The data shall be retained for the time necessary to fulfill these purposes and the legally required periods.
The user may exercise the rights of access, rectification, erasure, restriction, objection, and data portability, as well as file a complaint with the Spanish Data Protection Agency (www.aepd.es). For more information, the Privacy Policy available on the website may be consulted.
APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed by Spanish law.
In the event of a dispute, the parties shall submit to the courts and tribunals of the consumer’s place of residence, in accordance with consumer and user protection regulations.
